1. Agreement and eligibility
By creating an account, purchasing a plan, or using VodSpot, you agree to these Terms and the Privacy Policy. You must be legally able to enter a binding agreement and, if using VodSpot for an organization, authorized to bind that organization.
2. Service and accounts
VodSpot provides private video hosting, processing, playback, branded client deliveries, downloads, workspace collaboration, and related analytics. You are responsible for accurate account details, maintaining credential security, enabling appropriate access controls, and activity performed through your account.
You must notify us promptly of unauthorized access. Workspace owners control membership, roles, billing, and deletion decisions for their workspace.
3. Your content
You retain ownership of content you upload. You grant us a worldwide, non-exclusive, limited license to host, copy, transcode, stream, display, transmit, and otherwise process that content only as needed to operate, secure, support, and improve the service.
You represent that you have all rights, releases, and lawful bases needed to upload and deliver the content, including music, likeness, privacy, and client permissions. You are responsible for backups of important source files.
4. Acceptable use
You may not upload unlawful, infringing, abusive, deceptive, or malicious material; violate privacy or publicity rights; distribute malware; probe or bypass security controls; overload or reverse engineer the service except where law permits; resell access without authorization; or use VodSpot to facilitate harm.
We may investigate, restrict, remove, or preserve content when reasonably necessary to address abuse, security, legal requests, or violations of these Terms.
5. Trial and grace period
Eligible new workspaces receive a seven-day trial with 5 GB of video storage and no credit card required. The trial does not automatically become a paid plan.
At trial expiry, workspace changes and uploads are disabled and public Watch and Delivery links become unavailable. You then have three days to activate a paid plan. If no plan is activated, trial projects, videos, and client deliveries are permanently deleted. The account and workspace settings remain so you can subscribe later and start again.
6. Plans, storage, and add-ons
Plan prices, storage, seats, and feature limits are shown at checkout. Storage is calculated from uploaded video file sizes for quota enforcement. An optional recurring storage add-on provides 250 GB per purchased unit for $25 monthly or $250 annually, matching the base plan billing interval. New uploads are limited per billing month to half of the plan storage (the full storage in the first paid month, or six times the storage per year on annual billing); uploads that are later deleted still count. Storage add-ons do not increase this limit.
An add-on requires an active paid plan. If the add-on or base plan ends, its storage entitlement ends. You may need to reduce usage before uploading more content, and we may restrict uploads that would exceed the current allowance.
7. Billing, renewal, and cancellation
Creem is the merchant of record and processes charges, taxes, invoices, renewals, and payment details. Paid subscriptions and add-ons renew for the selected interval until cancelled. Cancellation normally takes effect at the end of the paid period unless checkout or applicable law states otherwise. When a paid subscription ends or its payment fails, the workspace becomes read-only and public links are paused; if it is not renewed within three days, its projects, videos, streaming copies, and client deliveries are permanently deleted, while the account and workspace settings remain.
Prices may change prospectively with notice. Failed or reversed payments may result in restricted access. Refund eligibility is described in the Refund Policy and any mandatory consumer law.
8. Client links and analytics
You decide who receives a Watch or Delivery link and whether to use password, expiry, download, and revocation controls. Links may be forwarded by recipients. Analytics are operational signals and may be affected by network conditions, privacy controls, shared devices, or blocked requests; they are not guaranteed to be exact.
9. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation. Features may change to improve security, performance, or product operation. Planned maintenance, provider outages, force majeure, or emergency work may affect availability.
10. Suspension and termination
We may suspend or terminate access for material breach, security risk, unlawful use, non-payment, or legal requirement. You may stop using the service or delete an eligible workspace from Settings. Provisions that by their nature should survive termination remain effective.
11. Disclaimers and liability
To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties. We are not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Our aggregate liability arising from the service is limited to the amount you paid for the service during the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.
12. Indemnity, law, and contact
To the extent permitted by law, business users will indemnify VodSpot against third-party claims arising from their content, unlawful use, or violation of another person’s rights. These Terms are governed by the laws applicable to VodSpot, subject to mandatory consumer protections and competent courts.
